January 18, 2012 - The new AFM Sound Recording Agreement has been ratified. Effective dates for the new 3-year agreement are January 16, 2012 through January 15, 2015.
Basic terms and conditions of the new agreement are as follows:
Scale Wage Increase
1/16/2012 – increase 2%
1/15/2013 – increase 1.5%
1/15/2014 – increase 1%
Pension
Pension will remain at 11.99% until the end of March as this is when the Rehab Plan is supposed to end. We will be getting confirmation on this so that we can make sure you have it in advance. The Pension % is suppose go back to the original rate before the Plan took effect.
H&W
Increased contributions will be $24 for the first service of the day and $19 for each additional service
Low Budget Location Recording
The AFM is creating a new provision for “Low Budget Location Recording” covering live performances made in a non-traditional studio setting which are made to promote an artist or recording and no tickets are sold for such performance. Non-exclusive examples are the Apple Store and SXSW (music conferences).
The low budget side letter is required and the following terms apply:
• Maximum budget shall be $20k
• Advance notice to AFM must be given
• B-forms must be prepared and provided to the AFM and the applicable Local
• Companies are to provide unit sales and distribution platform data to the AFM at the same time as the SPF reporting
• Rate is $83.34/hour ($250 for a 3 hour minimum) for each musician which permits the release of up to 60 minutes of music and image. Each additional increment of 7.5 minutes of music and image (or fraction thereof) may be released for an additional payment of $30 to each musician
• Any musician not affiliated with the featured artist will receive 150% (i.e. $125.01 per hour)
New provision for recording informal non-revenue performances where no tickets are sold (i.e. audio or video taken during a tour backstage or on the “back of the bus”) may be used as bonus material or other promo uses at no cost. If the product is sold consisting of this audio visual footage only then the terms of the Low Budget Recording shall apply.
